Welcome to FreshLabs. These Terms of Service ("Terms") govern your access to and  use of the FreshLabs website (tryfreshlabs.com) and the purchase of any products  from us. By using our site or placing an order, you agree to these Terms. Please read  them carefully. 

If you do not agree with any part of these Terms, please do not use our website or  purchase our products. 

1. About Us  

FreshLabs is a Pakistani skincare brand operated in Pakistan, developed in partnership  with Korean labs. References to "we," "us," and "our" mean FreshLabs.

2. Eligibility  

By using our website, you confirm that you are at least 18 years old, or that you are  using the site under the supervision of a parent or legal guardian. If you are purchasing  on behalf of a business, you confirm you have the authority to bind that business to  these Terms. 

3. Account Registration  

You may browse our site without an account, but certain features (such as faster  checkout and order history) require registration. When you create an account, you  agree to: 

- Provide accurate, current, and complete information 

- Keep your password confidential 

- Notify us immediately of any unauthorized use of your account 

- Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that  we suspect of fraudulent activity. 

4. Products and Pricing  

We make every effort to display our products, ingredients, and prices accurately.  However: 

- Product images are for illustration and actual packaging may vary slightly - Skincare results vary from person to person and are not guaranteed - All prices are listed in Pakistani Rupees (PKR) and are inclusive of applicable taxes  unless stated otherwise 

- We reserve the right to change prices, product descriptions, and availability at any  time without prior notice 

- In the event of an obvious pricing error, we reserve the right to cancel any order  placed at the incorrect price, even after order confirmation 

5. Orders and Acceptance  

When you place an order, you are making an offer to purchase. We will send you an  order confirmation email, but this confirmation does not constitute acceptance of your  order. A binding contract is formed only when we dispatch your order. 

We reserve the right to refuse or cancel any order at our discretion, including but not  limited to cases of: 

- Suspected fraud or unauthorized payment 

- Inaccurate or incomplete shipping information 

- Product unavailability 

- Pricing or description errors 

- Bulk or reseller orders not authorized by us 

If we cancel an order after payment, we will refund the full amount paid.

6. Payment  

We accept payment through the methods listed at checkout, which may include credit/ debit cards, bank transfers, mobile wallets, and cash on delivery (COD) where  available. By submitting payment information, you confirm that you are authorized to  use the payment method. 

For COD orders, we reserve the right to verify orders by phone, SMS, or WhatsApp  before dispatch. Repeatedly refused or undelivered COD orders may result in COD  being disabled for your account. 

7. Shipping and Delivery  

We ship across Pakistan through our courier partners. Estimated delivery times are  provided at checkout but are not guaranteed. Delays caused by couriers, weather,  public holidays, or events beyond our control are not our responsibility. 

Risk of loss and ownership of products pass to you upon delivery to the address you  provided. Please ensure your shipping details are accurate — we are not responsible  for orders delivered to incorrect addresses provided by the customer. 

8. Returns, Exchanges, and Refunds  

For hygiene and safety reasons, opened or used skincare products cannot be returned  or exchanged unless they are damaged, defective, or incorrect. 

If your order arrives damaged, defective, or incorrect, please contact us at  support@tryfreshlabs.com within 48 hours of delivery with photos and your order  number. We will arrange a replacement, exchange, or refund at our discretion. 

Refunds, where approved, will be processed within 7–14 business days through the  original payment method or as store credit.

9. Skin Quiz and Recommendations  

Our skin quiz and product recommendations are provided for guidance only and are  not a substitute for professional medical or dermatological advice. If you have a known  skin condition, allergy, or sensitivity, please consult a qualified dermatologist before  using any product. Always patch-test new products before full use. 

10. Intellectual Property  

All content on the FreshLabs website — including the FreshLabs name, logo, product  names, text, images, graphics, videos, designs, and the tagline "Good skin, har din" —  is the property of FreshLabs or its licensors and is protected by Pakistani and  international copyright, trademark, and intellectual property laws. 

You may not copy, reproduce, distribute, modify, or use any of our content for  commercial purposes without our prior written permission. Personal, non-commercial  use of the website (such as viewing and sharing on social media with proper credit) is  permitted. 

11. User Content  

If you submit reviews, comments, photos, or other content to our website or social  media, you grant FreshLabs a non-exclusive, royalty-free, worldwide license to use,  reproduce, and display that content for marketing and promotional purposes. You  confirm that any content you submit is your own and does not violate the rights of any  third party. 

We reserve the right to remove any user content that we consider offensive,  misleading, or inappropriate. 

12. Prohibited Use  

You agree not to: 

- Use our website for any unlawful purpose 

- Attempt to gain unauthorized access to our systems or interfere with their operation - Use bots, scrapers, or automated tools to extract data from our site - Resell our products without written authorization

- Misrepresent yourself or impersonate any person or entity 

- Upload any content that is defamatory, obscene, or infringing 

- Engage in any activity that violates the Prevention of Electronic Crimes Act 2016  (PECA) or any other applicable Pakistani law 

13. Counterfeit Products  

FreshLabs products are sold exclusively through tryfreshlabs.com and authorized retail  partners. We are not responsible for the quality, safety, or authenticity of any  FreshLabs-branded product purchased from unauthorized sellers. If you suspect a  counterfeit, please report it to support@tryfreshlabs.com. 

14. Disclaimers  

Our website and products are provided "as is" and "as available." To the fullest extent  permitted by law, we make no warranties, express or implied, regarding: 

- The accuracy or completeness of website content 

- Uninterrupted or error-free operation of the website 

- Specific skincare results from using our products 

- Fitness for any particular purpose beyond general cosmetic use 

Skincare results depend on individual skin type, lifestyle, environment, and consistent  use. 

15. Limitation of Liability  

To the fullest extent permitted by Pakistani law, FreshLabs and its directors,  employees, and partners shall not be liable for any indirect, incidental, special, or  consequential damages arising from your use of our website or products. Our total  liability for any claim arising from a purchase shall not exceed the amount you paid for  the product in question. 

Nothing in these Terms excludes liability for death, personal injury caused by  negligence, or any other liability that cannot be excluded under Pakistani law.

16. Indemnity  

You agree to indemnify and hold harmless FreshLabs, its officers, employees, and  partners from any claims, damages, or expenses arising from your breach of these  Terms or your misuse of our website or products. 

17. Privacy  

Your use of our website is also governed by our Privacy Policy, which explains how we  collect, use, and protect your personal information. By using our site, you consent to  the practices described in the Privacy Policy. 

18. Third-Party Links  

Our website may contain links to third-party sites or services. We are not responsible  for the content, policies, or practices of any third-party site, and inclusion of a link does  not imply endorsement. 

19. Changes to These Terms  

We may update these Terms from time to time. The "Last updated" date at the top  reflects the most recent version. Continued use of our website after changes are  posted constitutes acceptance of the updated Terms. 

20. Governing Law and Jurisdiction  

These Terms are governed by the laws of the Islamic Republic of Pakistan. Any  disputes arising from or relating to these Terms or your use of our website shall be  subject to the exclusive jurisdiction of the courts of Lahore, Pakistan. 

21. Severability  

If any provision of these Terms is found to be unlawful, void, or unenforceable, that  provision shall be severed and the remaining provisions shall continue in full force and  effect.
